THE LEGAL REGULATION OF PUBLIC CONSULTATIONS: INTERNATIONAL EXPERIENCE AND TASKS FOR UKRAINE

Abstract

Public consultations play a significant role in establishing partnerships between government and civil society in defining the priorities of the political process and socio-economic development of the state. Proper legal regulation of public consultation procedures allows the state and local authorities to resolve a number of important tasks: legitimize their decisions, establish a systematic dialogue between government and civil society in shaping and implementing public policy, and raising the level of political culture of citizens. Actualization of the legal provision on public consultations improving is due to the inadequate effectiveness of this instrument of democracy in domestic practice for all years of the legislation on public consultation creating. Meanwhile, the European vector of development of modern Ukraine requires the transition to European principles of good governance, international standards of public consultation, taking into account the recommendations for adaptation to the national legal systems. At the same time, each country remains its right to choose the legislative consolidation format of the application of this mechanism of public participation peculiarities. The analysis of the international documents norms suggests that public consultations can be an effective way of ensuring inclusiveness in public administration only in the case of a legal system regulates the interaction of public authorities and civil society institutions in a complex way. This requires the development of a tasking algorithm for further consolidation of Ukrainian legislation in this area.
