TERMINOLOGICAL NIHILISM IN THE INFORMATION SPHERE AND ITS IMPLICATIONS FOR THE INFORMATION SECURITY OF UKRAINE

Abstract

Under the current conditions, one of the most important areas of state policy in Ukraine is to ensure the state’s information security. Despite the efforts of academics and practitioners, the unresolved terminological problems continue to exist, which endangers both the formation of the policy itself and the profile of state institutions, and in the ways of its implementation. This leads to a complex current scientific and practical problem, which needs to be solved.

The article discusses and analyzes the controversial terminology in the information sphere, in particular, the legislation of Ukraine, shows the consequences of this situation for the state information security and further ways of ensuring it, which is reduced to such. The imperfection of the information legislation of Ukraine caused, in particular, by the inappropriate treatment of terminology in the information sphere, led to the uncertainty of the state information policy with the consequences of the implementation of mutually uncoordinated state mechanisms for ensuring information security of Ukraine, including due to the artificial and illogical formal separation of cybernetic space from the general information space. The improvement of the existing state requires a legislative definition of the essence of the state information policy of Ukraine on the basis of a clear conceptual apparatus and clarification of the directions of its implementation, the main of which should be the provision of information security of the state – a unified process regarding both cybernetic space and non-cybernetic space of information resources. By overcoming the negative situation, there is the creation (based on a unified approach to the essence of state information policy) the state mechanism for the implementation of the information security system of Ukraine in the understanding of the continuity of the environment of electronic and non-electronic information resources that fully complies with the requirement of Article 17 of the Ukrainian Constitution. To solve this problem it is necessary to make changes to the Law of Ukraine “On Information” regarding clarification of the term “information”, separating from it the concept of data, as well as introduce the notion of “data” and “state information policy”; to develop and adopt the Law of Ukraine “On Information Security of Ukraine”, which, in particular clarify the current notion of information security and ways of providing it in Ukraine, including in cybernetic space; to determine the authorized state authority on issues of management and coordination in the field of information security of Ukraine, as well as state authorities, are synchronized responsible for the implementation of state policy on the most important areas of information security; to define mechanisms of interaction of national subjects of providing information security of Ukraine, as well as the procedure of international cooperation in this field; to make changes to the National Security Strategy of Ukraine, considering it cyber security as a component of state information security, and to link the threats to information security with the current definitions of state information security in the Law of Ukraine; to update the valid Cybersecurity Strategy of Ukraine and the Doctrine of Ukraine’s Information Security in the light of the changes made to the Strategy of National Security of Ukraine and to consolidate into one document; lead structure of the Ukrainian authorities in compliance with the adopted changes in the domestic information law.
